PENNSYLVANIA APPELLATE COURT RULINGS


The Following is a list of a number of the court ruling handed down by the various courts in the State of Pennsylvania dealing with Hunting and Gun Rights issues. This page is offered for information only and is not intended to offer any legal advise.

PENNSYLVANIA SUPREME COURT


Ortiz v. Commonwealth of Pennsylvania Pennsylvania Supreme Court Ruling on Municipal Regulation of Firearms. This case involved a suit filed by a member of the Philadelphia City Council against the Commonwealth of Pennsylvania challenging the right of the state of Pennsylvania to prohibit cities organized under the Home Rules Charter and Optional Plans Corporation provison of the Pennsylvania Constitution, to regulate the private ownership of firearms.

PENNSYLVANIA COMMONWEALTH COURT RULING

Izbicki vs. Pennsylvania State Police  This is a case in which Commonwealth Court overruled the Pennsylvania State Police attempting to prohibit Izbicki from acquiring a license to carry a firearm in spite of the fact that Izbicki had obtain a order from Common Pleas Court to expunge his previous records.

Paulshock and Reed vs. Pennsylvania State Police.  This is a case in which both individuals obtain a relief from disabilities in order to puchase a firearm and were denied those purchases by the Pennsylvania State Police.  Both defendant appealed to Commonwealth Court and the court ruled against the PSP.

Reed vs. Pennsylvania State Police.  Order of the Court affirming the Administrative Law Judge's ruling that Mr. Reed has received expungment from prior record on reckless driving and can now purchase firearms.

PENNSYLVANIA SUPERIOR COURT RULING

James P. Ryan This is a case where the defendant appealed a lower court ruling expunging his record for involuntary committment to a mental facility.
